The said Williams, alias Kerr, is between 35 and 40 years of age, 5 feet 10 or 11 inches high, blue eyes, light hair, beard inclined to be sandy, under lip large and generally a sore about the middle of it, tolerably stout built, very fond of ardent spirits, and very noisy when drinking. He has a brother-in-law near Golconda, IL, and another near Fort Jesup, Louisiana. This same villain, it is pretty well ascertained, murdered a boy, a few years since, in the State of KY, by stabbing him.

LETTER OF JOHN SPEER TO THE AR GAZETTE
                                                     Clark County, November 1, 1836.
Mr. Editor - Pleased to give the following statement an insertion in your
                                                paper.
Jacob Brindley, of Pike County, who lives at the ferry on Little Missouri, has maliciously propagated, rumored, and charged me with harboring a certain Eli W. Kerr, alias E.K. Williams, (who has been charged with the murder of John M. Dickson, of Pike County).
Some most infamous individual, taking advantage of the sudden flight and absconding of Eli W. Kerr, alias E.K. Williams, from this County, personated him at my house in order the better to accomplish his homicidal or furtive design. The same individual has exhibited himself at and about my house, at all times of the night, striking on the fence, whistling in chargers, and making various other noises and pranks, which caused me, together with my neighbors, to believe that the above-named murderer of John M. Dickson was at my house, until contradicted and ascertained by the following statements:
This Eli W. Kerr, alias E.K. Williams, was seen and met by John W. Williams, a highly respectable gentleman who lives on the Military road seven miles from Washington, Hempstead County, on the road seven miles from Golconda, IL, the 22nd. day of August last (on his way from this country). The said Eli Kerr, alias E.K. Williams, was seen also by Wiley A. Berry, of Livingston County, KY, William Berry, and Nathaniel Gray, of the same County, six hundred miles from this County, about the last of August; not withstanding, this other base rascal, who was essaying to pass himself, for some malicious design, for Eli W. Kerr, alias E.K. Williams, was seen on the 28th. of August by Elijah Kelley near my house, and by Samuel Hasley, and by Amos Wilson on Wednesday night the latter part of August; and on Thursday following by Moses Guice; on Friday, by Dr. Long, (who) told Jacob Brindley, that this supposititious (sic) individual had been seen by many persons, and that he did not believe it was Eli Kerr, and that several men were watching and lying in wait for him and that I wished him either taken or killed.
Since Dr. Long had that conversation with Jacob Brindley, that villainous individual has not been seen nor heard at my house or about my plantation. The said Jacob Brindley has used every exertion in his power, by his base culumnies, to injure my standing and reputation; and by his multifarious lies, fabrications, and equivocations, has left no dubiousness on the mind of the public as to that individual who attempted to pass for Eli W. Kerr, in order to evade justice in the execution of his murderous design, detraction or villainy.
For evidence you will see the following certificates.

Williams, who committed a murder on the body of John M. Dickson, on the 2d. day of July last, in the County of Pike, and that he was then on his way from this country.

Given under my hand, this 3rd. day of October, 1836.

                                                     AFFIDAVIT OF WILIE A. BERRY
I, Wilie A. Berry, of Livingston County, KY, do hereby certify, that I am personally acquainted with a certain Eli W. Kerr, alias E.K. Williams, the individual who is charged with the murder of John M. Dickson, of the County of Pike, AR; and that some time in the latter part of August, in the present year, I saw the said Eli W. Kerr, alias E.K. Williams, in Livingston County, KY, and was informed by him, that he had come directly from AR.

Sworn to and subscribed before me, this 7th. day of October, 1836.

Certificate of Elijah Kelley and Samuel Hasley
We the undersigned, do certify, on the night of the 28th. of August, or about that time, we were in the company of John Speer, at his dwelling house, watching for E.K. Williams, murderer of John M. Dickson, and near about twelve o'clock of said night, we saw a man appear three times, in the distance of eighty yards, as nigh as we can guess, and from the action of the person we saw, we think he either wanted to see some one privately, or to steal, rob, or murder.
                                                           ELIJAH KELLEY
                                                          SAMUEL HASLEY
                                                          October 8th., 1836.

                                                     TO THE PUBLIC
A certain "Major" John Speer, who keeps a house of entertainment in Clark County, near the Antoine Bridge, on the road leading from Little Rock to Red River, in order to get into a newspaper controversy with me, or to give the public a specimen of his very extraordinary talents for writting, (sic) has published, in the AR Gazette, a lengthy and windy communication, over his own signature, dated November 1st., 1836, in which he charged me with having "maliciously propagated, rumored, and charged" him with harboring (his brother-in-law) Eli W. Kerr, alias E.K. Williams, who stands charged with the crime of murder, in Pike County; which communications has attached to it the certificates of certain persons, certifying that the fact of Williams, alias Kerr, have been seen, after the perpetration of the crime above mentioned, in the States of IL and KY. The said communication also charges some person with endeavoring to personate the said Williams, by "striking on the fence, whistling in chargers, and making various other noises and pranks, at and about the house of the said John Speer."
Not wishing to trouble the public with my grievances about the above named communication, I would barely remark, that circumstances as strong as holy writ, establish the fact of John Speer having harbored the said Eli W. Kerr, alias E.K. Williams, "at and above" his house, after the perpetration of the murder above named; and the "suppositious individual" mentioned in said communication, who endeavored to "personate" said Williams, at and above the house of said John Speer, is generally believed to have been the servant of this John Speer, or some other person induced to come there for him, for the purpose of screening him from the charges of harboring said Williams. Circumstances go strongly to show this fact to every unbiased mind. I have never "maliciously charged" John Speer with the commission of an act. I have spoken of the affair in common with those whom I have heard conversing on the subject, but not with the view of injuring him. He has no laurels that I wish to take from him. His reputation, whatever it may be, he is welcome to enjoy.
I would barely remark, in conclusion, that this Major John Speer has admitted that E.K. Williams, alias Kerr, ate at or near his house, after the commission of the murder mentioned in his communication. This admission, therefore, puts him at issue with his communication. Add his admission, therefore, to the circumstance of a stolen horse being found in his possession, and it will show whether he is the man he has cracked himself up to be, in his garbled communication, or not.
                                                          JACOB BRINDLEY
Little Missouri, Pike County, AR, 1st. December, 1836.

                                                      FOR THE AR GAZETTE
Mr. Editor - I notice in your paper of the 13th. of the present month, a
publication over the signature of one Jacob Brindley, of Pike County, bearing the date the first of the same month, in which he denies any purpose of doing me injustice, at the same time making as false assertions against me as ever were made against a man, when he charged me with having harbored E.K. Williams, and of having the horse, (stolen by Williams), in my possession, if he had stated that I arrested the horse in his possession, and informed the proper person of it, who was authorized to receive him, he would have stated the truth.
The fact of my having taken the horse from the possession of the thief, can be proven by a gentleman by the name of Swink, living at Judge Barkman's, and the fact of me having sent word that I had taken possession of a horse, supposed to be stolen, can be established by Moses Grize (Guice), who lives with Col. Wilson. This took place on the 15th. or 20th. of July last - and he was personated at my house in the later part of August last.
The charge of this having been done by my servant, or at my request, that I might not be suspected, is one of the vilest things I have ever seen or heard of. If it was done through my influence, (and not through Brindley's), why did that villain stop on the very same day, that Dr. Long told Jacob Brindley of, the danger that Williams was in? The evidence and circumstances all go strong against Brindley himself.
Now, Mr. Jacob Brindley, a word or two with you, and I am done. Your false assertions against me, make it my duty to call your attention to a few facts in regard to your being a man of truth.
Did you not, some time previous to the expiration of the preemption law, swear before Almighty God, that there did not exist a preemption on a certain tract of land. I allude to the tract of land on which Francis Bittick has his farm, - and did you not deny in the presence of James Ward, Senior, that you were sworn at all? - and after denying that you were sworn, did you not admit to the same person that you were sworn, but did not take the oath prescribed by law? Now sir, if there was no preemption, why did you deny swearing at all?
And did you not state a falsehood, between Col. J. Wilson and James Ward, concerning a load of salt sent by Col. Wilson to Ward. Now, sir, if you are not guilty of the above charges, Mr. Ward is your neighbor and will acquit you.
Were you not, sir, called on by Samuel Hasley for having made too free use of his name? And did you not deny the facts in the most positive terms, and did not the said Hasley call on John McLaughlin, and prove positively that you did use the words denied by you - and did you not contradict McLaughlin? - or was your plea that you were in a state of insanity? Now sir, if you are not guilty, these are men of truth and will do you justice. If you fail to clear up these charges, your base statements will not be noticed.

                                                     EDITORIAL
A more striking exemplification cannot be found of the folly and weakness
of human passions, than the correspondence which has been carried on in this paper in the shape of advertisements between John Speer and Jacob Brindley, Esqs., one of Pike County, and the other of Clark County. They have been endeavoring to persuade the world, (each other), that they are the most corrupt mortals alive, when in fact we have no better citizens in the country than both of them. They ought from shame, to discontinue the affair where it stands.

Oliver Brewer Sr. was born in 1775 at Hillsboro District, Chatham County, NC. He was the son of William Brewer and Phanah Sally Resden. Oliver Brewer Sr. married Sarah ______ circa 1792 at NC.
According to an article in the Chronicles of Oklahoma (see Phillip Doddridge Brewer for text of complete article) Oliver was born in the Hillsboro District of Chatham County, NC and moved to Tennessee and to Missouri and settled in Pike County Arkansas. He died there on December 13, 1834. He had two wives. The first bore him a son Henry on October 30, 1799. He also had a daughter (Rosanna) by the first wife. (Note: there is no mention of a John as one of his children.) The second wife (whose name is not given in the article) was born on December 27, 1787 and died December 10, 1827. The dates of Oliver Brewer and his children used herein are from this article. The article attributes the dates to "an old family Bible in the possession of Mrs. Cora Rountree, of Murfreesboro, Pike County, Arkansas, who is a descendant of Lucinda Brewer." The article gives the bone fides of the Bible.
From Gems of Pike County Arkansas Volume IV Number 4 comes the following article:
"Oliver Brewer came to Arkansas from Bellevue, Washington county, Missouri and settled in Hempstead county in 1818 or 1819. From two marriages he had a large family of sons and daughters: John, Henry, Oliver Jr., Rosanna, Henderson, William Lewis, James Stephenson, Lucinda, Rebecca, Mary, Mathilda, and Luvisa.
"William Brewer, whose specific relationship to Oliver Brewer has not been determined, likewise settled at the forks of the Little Missouri, his immediate neighbors included Joseph Galbreath, Noah Reeder and Stacia Davis. His family included his wife Sarah "Sally" Brewer and children, William Jr., Harmon, Rebecca and Elizabeth Brewer. Harmon Brewer married Martha Green; Rebecca Brewer became the wife of David S. Major William Harrison Preston died on January 8, 1873 at Murfreesboro, Pike County, AR. ["The many friends and acquaintances of Maj. Wm. H. Preston of Murfreesboro, Pike Co., will be shocked to learn that he is no more, and that he died by his own hand. On the evening of the 7th inst. (January 7, 1873) we learn that he went into a room to change clothes and remained so long that his wife became uneasy about him and went into the room to ascertain the cause, when to her horror, she found him on the bed and four empty one ounce bottles labeled "Laudanum" sitting on a chair nearby. When his wife entered the room he pointed to the bottles and remarked that she could see what he had done for himself. A physician was immediately summoned, but Maj. Preston stoutly refused to take any antedote declaring it to be his full and unalterable determination to destroy his life. He died about six o'clock next morning (January 8, 1873)."; Southern Standard, January 18, 1873, page 3, column 2; Washington Telegraph, January 15, 1873.].

In life the expression of his face was kindly; his eyes clear and unafraid; his manner gentle and every expression candid. He knew how to grow old gracefully with an apparent satisfaction of life in full confidence that he was in the early future going to walk through an open door. As a loving, kind, considerate and devoted husband and foster parent, an active, faithful and useful citizen, and an able lawyer and upright judge, he will be long remembered by the citizenship of this state. As a member of said Board and vice president thereof, his wise counsel in the administration of the affairs of said society and careful and efficient attention given to the duties of same, and his kindly fellowship will long be appreciated and remembered by his associates, with the realization that his place will be difficult to fill.
Now, therefore, on behalf of each and every member of this board to his surviving widow, Mrs. Annie L. Brewer, and his foster daughter, Mrs. Edward P. Allen, and her husband, Dr. Edward P. Allen, and their sons Edward Philip Allen, Robert Allen and Paul Allen, and other relatives, we express our sincerest sympathy on account of the great bereavement occasioned by his death, and direct the secretary to furnish them copies of this resolution.

"Published by Waugh and T. Mason, for the Methodist Episcopal Church at the Conference Office, 14 Crosby Street,
                                                                                          J. Collard, Printer.
                                                                                          1832"
Brewer Owens, who was raised by his grandfather, Henry Brewer, says that his said grandfather told him that Oliver Brewer, the original Arkansas settler of their family, had a daughter by his first wife whose name he does not remember and who was a full sister to said Henry Brewer, and that after her marriage she moved to the west, probably to Oregon. He recalls correspondence with her family after the Civil War but such letters have been lost. John H. Haynes, of Hope, Arkansas, is a descendant of Henry Brewer, his grandmother's name being Lucinda Brewer. The Hon. Earl Brewer, formerly Governor of Mississippi, was also descended from the Brewers who came from Chatham County, North Carolina. The Brewers were of English descent, first settling in Virginia, their land grant being located in what is still known as "Brewer's Neck," which is between Brewer's and Chuckatuck Creeks, the patent being to John Brewer, who was a member of the House of Burgesses for Wamick River 1629-30. He was also Commissioner, being a member of the Council in 1632, dying somewhere about 1635. His will has been published in Waters Gleanings in the New England Historical & Genealogical Register, the recital being: "Will of John Brewer, citizen and grocer of London. 4th September 1631. Proved (in England) 13th May 1636." It shows that his father was named Thomas Brewer and that he had a son by the name of John Brewer, to whom was willed his plantation in Virginia called "Standley Hundred," and refers to another plantation called "Brewer's Borugh." His wife was named Mary. He had a son by the name of Roger Brewer, and a daughter named Margaret Brewer. He also had a brother named Thomas Brewer. He had an uncle named Roger Drake, obviously his mother being a Drake. The Brewer family from which Philip Doddridge Brewer was descended branched out from Virginia, settling in North Carolina, the Missouri Brewers coming from North Carolina. The father of Judge Philip D. Brewer, John Oliver Brewer, was named after his grandfather Oliver Brewer, and some say that he was also named John Oliver Brewer. O. J. M. Brewer, of Heavener, Oklahoma, is a son of William C. Brewer, full brother of John O. Brewer of Sebastian County, Arkansas. There is a division in the narration as to how the Brewer family came from near Boonville Missouri, to Arkansas; one branch of the family saying they came down what was called the "Old Buffalo Trail," by way of Little Rock, which was afterwards surveyed and called the "Military Road," and that by said trail the Brewers and their fellow settlers came from Missouri with ox teams settling near Murfreesboro in Pike County, Arkansas, about 1818 or 1819. The other account is that said party floated down the Missouri River to and down the Mississippi River, to and thence up Red River disembarking at a point near Fulton, Arkansas, and settling at a point near Murfreesboro in Pike County, Arkansas. In any event this party were among the first settlers in said section in Arkansas Territory.
At the outbreak of the Civil War in 1861 Judge Philip D. Brewer's father, John Oliver Brewer, was county surveyor of Sebastian County, Arkansas. He enlisted in the Union Army, serving in that capacity until 1863 when he died, being buried in the Union Soldier's section in the cemetery at Fayetteville, Arkansas.
His mother Sarah Louise Council, who was born in Alabama, came to Arkansas in 1858 whilst a girl, and married his father at a point near Hackett. His father dying in his infancy he and his mother continued to reside in the community, struggling against the adversities and vicissitudes, following the war. She died in 1913 at the age of eighty-three years and is buried in Hackett, Arkansas.
Being anxious to secure an education, the opportunities for which were meager on account of the devastation occasioned by the Civil War in that section, having attended available local schools, in 1877 he entered Asbury College, now DePauw University, at Greencastle, Indiana, where he was a student for a short while. This constituted all educational advantages except what he received at home and through his own personal efforts as a self-educator. Being ambitious to become a lawyer he studied at home and under the occasional tutorship of the Hon. J. S. Little, of Greenwood, Arkansas, State Prosecuting Attorney for that Circuit, and later Circuit Judge, Congressman, and Governor. Judge Philip D. Brewer was admitted to the bar after an examination in open court at Greenwood, Arkansas, on December 20, 1886. J. A. Hale, who was afterwards his law partner, and C. D. James, were admitted to the bar in the same order. He opened an office at Hackett, practicing in the Circuit Court at Greenwood and Fort Smith and at other points. He was elected as a Democrat to the Lower House of the Arkansas State Legislature at an election held in the fall of 1890, serving during that session which extended from January 12th, to April 3, 1891. Continuing in the active practice of the law with an office at Hackett, when the United States Court was established at Cameron, Indian Territory, in 1895, he opened an office at that point, under the firm name of Brewer & Hale, the junior member being James L. Hale, who now resides at Poteau, Oklahoma. He retained his residence and office at Hackett for a short while, dividing his time with the Cameron office, until he disposed of pending litigation on the Arkansas side. In the fall of 1895 he removed to Cameron to take care of growing business on the Indian Territory side, where he remained until the fall of 1897, then removing to McAlester, Indian Territory, and engaging in the practice of the law there under the firm name of Hale & Brewer, the senior member of said firm being the late Jap A. Hale. At the termination of this partnership he engaged in the practice of the law there under the firm name of Horton & Brewer, the senior member being William J. Horton. Later this partnership being dissolved he continued the practice of the law there under the firm name of Brewer & Andrews, the junior member being Guy L. Andrews. In 1909 he was appointed by the Governor as Judge of the Superior Court for Pittsburg County, which office had recently been created by an act of the Legislature. In 1910 having been elected for a full term to said office he continued in that capacity until he was appointed to the Supreme Court Commission in 1911. On August 1, 1911, he removed to Oklahoma City, having qualified as Supreme Court Commissioner, all the time being a presiding judge of a division and holding such office by reappointment, until he resigned in 1916 to engage in the practice of the law in Oklahoma City under the firm name of Vaught & Brewer, the senior member being Edgar S. Vaught now United States Judge for the Western District of Oklahoma, and so continued in the practice of the law until his retirement in 1926 on account of his health, the firm being at that time Everest, Vaught & Brewer.
The opinions prepared by him on the appellate court in reasoning, statement, and language disclosed a sound judicial capacity, learning and grasp of marked distinction. In the practice of the law in the Capital City he appeared only occasionally in the trial courts, being constantly engaged before the Supreme Court of the State, United States Circuit Courts of Appeal and Supreme Court of the United States, when not engrossed as a counselor, in all of which his work and achievements were of the first order.
He was a Mason, becoming a member of the Grand Lodge of the Indian Territory in 1898 at Wynnewood, later serving as Grand Orator, Grand Senior Warden, and Deputy Grand Master.
In 1903 he was elected Grand Master of the Grand Lodge, A. F. & A. M. of Indian Territory, serving one year. He had also served as Worshipful Master of his local lodge. He received the Master Mason's degree in October, 1882, in Amity Lodge No. 267 at Hackett, Arkansas, serving as a Deputy Grand Master in the Arkansas jurisdiction. He received all degrees of Masonry from the third to the thirty-second and the Scottish Rite Consistory at McAlester, Oklahoma, and was a member of India Temple Shrine, Oklahoma City.
In politics he was a Democrat. In 1900 he became a member of the Indian Territory Democratic Central Committee and so continued until 1904. In his quiet but effective way for years he participated in the Democratic organization activities. At McAlester he served a number of years as a member of the school board.
A successful business man and a lawyer, for a number of years he was a director of the First National Bank of McAlester, and after retiring from the Supreme Court Commission, engaging in the active practice of the law, he participated in the organization of, and became a director of the Liberty National Bank of Oklahoma City, so continuing until his death. For a number of years he was its general counsel.
In early life he became a member of the Methodist Episcopal Church South, for years a member of the Board of Stewards of St. Luke's Methodist Church at Oklahoma City, and at the time of his death a trustee.
He also took an active interest in the Oklahoma Historical Society, having been for years prior to his death a Vice-President and Director. He was a member of the committee appointed by the Oklahoma Historical Society at an annual meeting, and approved by the Legislature, to act jointly with the State Board of Affairs in the construction of the Oklahoma Historical Building, his name being carved on the corner stone as a member of said committee.
He was a member of the Oklahoma Golf & Country Club and Men's Dinner Club at Oklahoma City.
Whilst on all occasions displaying an admirable dignity, yet at times he disclosed a sense of quiet humor that was refreshing. His attitude towards early friends, especially those from the environs of his native country, evidenced highest appreciation of the refinements of friendship.
Able, well poised and open - frank, firm but kind - he faithfully met every obligation to his fellow man, country, Church and God. As a faithful and dependable friend, kind and loving husband, and foster father and grandfather he will be remembered. As an ethical lawyer and upright judge he was of the first rank, excelling not only in ability but also in character.
Married on November 25, 1894, at Hackett, Arkansas, he is survived by his widow, Mrs. Anna L. Brewer. In his death the state lost one of its best citizens."
