This Indenture made the 5th Day of July in the year 1828 between Joel Henderson of the County of Christian and Commonwealth of Kentucky of the one part and George Nichols of the County of Todd and Commonwealth aforesaid of the other part Witnesseth that the said Joel Henderson for and in consideration of one thousand and twenty five dollars in hand paid the receipt whereof is hereby acknowledged hath granted, bargained and sold and by these presents doth Grant, Bargain and sell unto the said George Nichols his heirs and assigns all that tract of land or parcel of land situate and being in the county of Christian on the watters (sic) of Fend river and bounded as follows(to wit) beginning on a walnut near a spring thence North 55 East127 poles to two white oaks and walnut thence N. 92 W. 127 pole to a poplar thence S. 55 W. 127 poles to a stake Thence South 35 E. 127 poles to the Beginning Also one other tract lying in the County and State aforesaid and on the waters aforesaid containing sixty acres and bound as follows (To wit) beginning on a walnut most southwardly corner of a survey of one hundred acres made in the name of John Martin thence with a line thereof N. 55 E. 94 poles to a stake thence S. 3 E. 16 poles to two Hickorys (sic) thence S. 17 E. 74 Poles to a post oak thence S. 14 W. 21 poles to a post oak and black jack thence S. 60 W. 82 poles to a stake thence N. 17 W. 66 poles to three black oaks thence N. 89 W. 50 poles to a large post oak thence N 35 W . 54 poles to a stake thence N. 55 E. 40 poles to a stake in a line of said 100 acre survey thence with said line S. 35 E 64 poles to the Beginning Also one waggon (sic) and gear one black horse on sorrel mare two sorrel colts, four cows and calves. Eleven head of young cattle forty head of hogs, twenty head of sheep, four beds with their furniture and Bed steads One Bureau and Chest 1 Cupboard and furniture fourteen chairs one table five water pails Two side saddles two men's saddles and twenty five geese To have and to hold the aforesaid Tracts of land and above described personal estate conveyed hereby with the appurtenances unto the said Nichols his heirs and assigns forever and the said Henderson for himself his heirs, executors and administrators the aforesaid tract of land and appurtenances unto the said Nichols his heirs or assigns against the claim or claims of all and every person or persons Whatsoever doth and will forever warrant and defend by those presents(?) Provided that the grantor is indebted to the Grantee in sum of one thousand and twenty five dollars due on the 25th day of July 1828 and will appear by note bearing ____ with this mortgage and if he shall or any person for him will and truly pay the said sum of money with interest, agreeably to the demand thereof then this Indenture to cease and be of no effect otherwise to remain in full force and be of no effect otherwise to remain in full force and Virtue In witness whereof I have hereunto set my hand and seal the date above written
