State of Arkansas,
County of Hempstead,
Be it remembered that on the thirty-first day of May in the Eighteen Hundred
and Thirty-nine, James Hughes, of the County of Pike, in the State of
Arkansas, personally appeared before me the undersigned and acting Justice
of the Peace in and for the County of Hempstead in the State of Arkansas and
being by me duly sworn in the presence of the Register and Receiver of the
Land Office at Washington, Arkansas, Deposeth and Saith: that he is a
married man, the head of a family consisting of a wife and six children, and
Thirty-Eight years of age; and that in the month of November in the year
1836 he removed to and settled with his family on a portion of the public
Lands of the United States upon two tracts of Land known and designated as
the West half of that portion of the South West Quarter of Section six,
situated on the East side of Little Missouri River and also that portion of
North West quarter of Section seven, situated as aforesaid in Township
Eight, South Range 25, West of the principle meridian in the district of
Lands subject to sale at the Land Office in Washington, Arks., containing
in the aggregate, ninety-four 62/100 acres and that he immediately
afterwards, he so removed and settled as aforesaid, built a dwelling house
for his residence and other out houses and that said Houses are on that
portion of the south West quarter of Section Six, aforesaid; and that he
cleared, fenced and cultivated in the year 1836 about Twenty-five acres of
Land which said cleared Land was made on both, above described; and that he
still continues to open and improve said Tracts until this day; that his
improvement contains about Twenty-five acres on one part and Ten on the
other part; he further states that he actually resided upon said tract with
his family and had possession thereof by actual personal residence, thereon,
on the 22 day of June in the year 1838, and for four months next preceding
that day and that he still resides thereon with his family and has
possession of the same; and further sayeth not.

And at the same time and place came John Hughes, Hiram Kizzia, and being
duly sworn states on oath: that, they both personally know the above named
James Hughes and that they know him to be a man over Twenty-one years of age
and a man at the head of a family as in his affidavit as stated; and that he
has resided upon and cultivated the tracts of Land in his affidavit
described or as his affidavit is describing and that he had actual
possession thereof by actual personal residence thereon on the Twenty-second
day of February, 1838 and for four months next preceding that day; and that
he still resides on and has possession of the same, and further says not.

James Hughes personally came before me the undersigned a Justice of the
Peace within and for the County of Hempstead in the State of Arkansas; and
being duly sworn, deposeth and saith: that he entered upon the tracts of
Land in his proof of his claim to Preemption this day filed with the
Register of the Land Office at Washington, Arkansas in and to that portion
of the south west quarter of Section six situated on the East side of Little
Missouri River and also that portion of the North West quarter of Section
Seven situated as aforesaid in Township Eight South of range 25, West of the
5 principle meridian in the district of Lands subject to sale at Washington,
Arkansas containing in the aggregate ninety four 62/100 acres in his own
right and exclusively for his own use and benefit and that he has not
directly or indirectly made agreement or contracted in any way or manner,
any person or persons, whatever, by which the title which he may acquire
from the government of the United States will inure to the use or benefit of
any one except himself; or to convey or transfer the said lands or to the
title that one may acquire to the same; to any person or persons whatever at
any subsequent time.

Received from James Hughes of Pike County, Arkansas - One Hundred and
Eighteen dollars and Twenty Eight cents being in full payment for that
portions of the South West Quarter of Section Six and North West quarter of
Section Seven on the East Side of Little Missouri River in Township Eight,
South of Range Twenty-five West, containing Ninety four 62/100th acres at
$1.25 per acre.

It is hereby certified: That in pursuance of Law, James Hughes of Pike
County, State of Arkansas on this day purchased of the Register of this
office the Lot or That portion of the South West Quarter of Section No. Six
and the North West Quarter of Section No. Seven on the East Side of Little
Missouri River in Township No. Eight South of Range No. twenty five West,
containing nienty four and sixty-two hundredths acres at the rate of one
dollar and twenty-five cents per acre amounting to One hundred & Eighteen
dollars and twenty eight cents, for which the said James Hughes has made
payment in full as required by Law.
Now therefore be it known: that on presentation of this Certificate to the
Commissioner of the General Land office, the said James Hughes Shall be
entitled to receive a patent for the Lot about described.
