John Caruthers to James Miles

Deed of Conveyance

This Indenture made and entered into this 10th day of December in the year   
of our Lord one thousand eight hundred and twenty-one, between John          
Caruthers of the County of Clark and Territory of Arkansas of the first      
part, and James Miles of the same place of the second part.                  
                                                                             
Witnesseth, that for and in consideration of the sum of six hundred dollars  
to him the said John Caruthers by the said James Miles, the receipt of which 
payment is hereby acknowledged, he the said John Caruthers for himself, his  
heirs &c., hath this day granted, bargained, sold, aliened, transferred,     
confirmed and conveyed, and by these presents doth bargain, grant, sell,     
alien, transfer, confirm and convey unto said James Miles, his heirs and     
assigns forever, all and singular my right, title, interest and claim I have 
in and to an Improvement of the following description and situation: The     
improvement being a preemption claim - situated and lying in the County of   
Clark and Territory of Arkansas on the waters of Wolf Creek, viz: in the     
North East quarter of Section Thirty-five, Township Eight, Range             
twenty-three West, of the Fifth Principal Meridian. The aforesaid            
improvement being the one which Thomas Wood made and conveyed unto Jeremiah  
Conway, and said Conway to William Gentry, and said Gentry to William        
Hemphill and said Hemphill to me; to have and to hold to the said James      
Miles, his heirs and assigns forever, together with all the appurtenances    
thereunto belonging to said improvement or in any wise appertaining thereto. 
And, the said John Caruthers for himself, his heirs &c., covenant(s) to and  
with the said James Miles, his heirs and assigns, well and truly to warrant  
and forever defend all and every claim or claims of him, the said John       
Caruthers, his heirs &c., and from all and every person claiming by, through 
or under them, the aforesaid improvement or preemption claim as above        
described, unto said James Miles, his heirs and assigns forever.             
                                                                             
In testimony whereof, the said John Caruthers hath hereunto placed his hand  
and affixed his seal this tenth day of December in the year of our Lord one  
thousand eight hundred and twenty-one: and of the Independence of the United 
States of America the Forty Sixth.

This day, John Caruthers personally appeared before me, Henry L. Biscoe,     
Clerk of the Court of Common Pleas for the County aforesaid, and             
acknowledged the within deed of conveyance to be his voluntary act and deed, 
hand and seal for the purposes therein mentioned and contained.              
                                                                             
Given under my hand and private seal, this tenth day of December A.D. 1821   
and of the Independence the 46th.

Clark, do certify the foregoing to be a true copy of the original which I
